At its core, estate planning is the process of arranging for the management and distribution of your assets during your life and after death. That includes your home, savings, retirement accounts, personal belongings, and even the guardianship of your minor children.

Estate planning isn’t just about who gets what—it's about how, when, and why you want your legacy handled in a certain way. You decide:

  • How much you want to pass on

  • Who should receive your assets

  • How they should inherit them

  • When that transfer should take place

These are deeply personal decisions, and at Pickler Law, we believe the right estate plan is not a one-size-fits-all template.

Key Components of Estate Planning

Wills

A Will is a legal document that outlines how your assets will be distributed after your death. It allows you to name an executor (also known as a personal representative) to manage your estate. Without a Will—known as dying “intestate”—the court appoints someone (an administrator) to settle your affairs, which could lead to decisions that do not align with your wishes.

Real-World Example: Consider the estate of artist Pablo Picasso. He died in 1973 without a Will, triggering a six-year legal battle involving numerous heirs and an estimated $30 million in legal fees. Similarly, Myra Clark Gaines’ inheritance case lasted a record-breaking 57 years, reaching the Supreme Court 17 times.

Trusts

A Trust is a legal structure that allows a third party (a trustee) to hold and manage assets on behalf of your beneficiaries. Trusts are often used to avoid probate, protect privacy, reduce estate taxes, or manage distributions over time (especially for minors or individuals with special needs).

Power of Attorney

A Power of Attorney (POA) authorizes someone you trust (your Agent) to manage financial or legal matters when you’re unable to do so. It’s a crucial safeguard against the unexpected.

Advanced Healthcare Directives

This includes a Living Will (what treatment you do or don’t want) and a Healthcare Power of Attorney (who makes medical decisions for you if you cannot). These documents give your loved ones clarity and peace of mind during stressful medical moments.

Beneficiary Designations

Accounts like life insurance and retirement plans with beneficiary forms often bypass your Will altogether. Keeping these forms up to date is key to avoiding unintended outcomes.

Guardianship Designations

If you have minor children or dependents with special needs, naming a guardian ensures they are cared for by someone you choose, rather than the court.

Why Estate Planning Matters

  • It puts you in control: Without a plan, state law dictates everything, from asset distribution to child guardianship.

  • It can minimize taxes and legal costs: Thoughtful planning keeps more of your estate with your loved ones.

  • It protects your loved ones: Clear instructions reduce conflict and confusion.

  • It handles incapacity: POAs and healthcare directives ensure your wishes are followed if you're unable to speak for yourself.

  • It lets you leave a legacy: Want to support a charity, place of worship, or alma mater? Estate planning gives you the tools to do so.

  • It eases emotional burdens: Having a plan helps your family grieve without also having to navigate legal chaos.

Final Thoughts

Estate planning isn’t just for the ultra-wealthy or elderly. It’s for anyone who wants to control their financial and personal future. At Pickler Law, we’re here to make the complex feel manageable, and to help you create a plan that reflects your values and protects the people you love.
